What this value means

PAYMENT CONVENTION — this is load-bearing and the single most common source of wrong Spanish SMI figures. Art. 1 RD 126/2026 fixes the SMI at 40.70 EUR/day OR 1,221 EUR/month, and the monthly figure is legally expressed in FOURTEEN payments per year (twelve monthly plus two statutory extra payments, pagas extraordinarias). The value served here is the statutory 14-payment monthly figure, 1,221 EUR. The equivalents are: 17,094 EUR gross per year (art. 3.1 uses this as the annual reference), and 1,424.50 EUR per month if the annual total is prorated over TWELVE payments — a convention many employers use and many secondary sources quote without saying so. Do not compare 1,221 against a 12-payment figure from another country without converting. TIMING QUIRK: the RD was published 19 February 2026 and entered into force 20 February 2026, but by its final provision it takes effect for the whole calendar year 1 January - 31 December 2026, so employers owed retroactive top-ups for January and part of February. This retroactive-Q1 pattern recurs almost every year in Spain. The increase is 3.1% over the 2025 figure set by Real Decreto 87/2025 (+37 EUR/month, +518 EUR/year over 1,184 EUR / 16,576 EUR). The RD also fixes rates for temporary workers engaged by the same firm for 120 days or less (a higher per-day figure) and for domestic household employees (an hourly figure); those are sub-schedules, not the general floor. The SMI is a single national floor — Spain is NOT a matrix jurisdiction for minimum wage; autonomous communities cannot set their own, though collective bargaining agreements (convenios colectivos) routinely set higher sectoral minima. Note also the widely reported political point that the 2026 SMI remains exempt from IRPF withholding at the minimum level ('sin tributación'), which is distinct from the wage figure itself.
