What this value means
This is the GENERAL CIVIL rate — the interés legal del dinero. Código Civil art. 1108: where a money debt is unpaid and no rate was agreed, damages consist of the legal interest. It is fixed annually in the Ley de Presupuestos Generales del Estado (mandated by Ley 24/1984 art. 1), and where no budget is approved before 1 January the previous budget is automatically prorogued under art. 134.4 of the Constitution, carrying the rate with it. That is why 3.25% — set for 2023 by Ley 31/2022 — is still the rate in 2026: the 2023 budget has now been prorogued through 2024, 2025 and 2026, and no Ley de Presupuestos has been approved since. DO NOT USE FOR B2B COMMERCIAL DEBTS: Spain's late-payment rate for commercial transactions is set by Ley 3/2004, de 29 de diciembre, de lucha contra la morosidad (ECB reference rate + 8 percentage points, published half-yearly by the Ministerio de Economía in the BOE) — served separately as this API's late-payment-interest product. THREE FIGURES ARE ROUTINELY CONFUSED WITH THIS ONE: (1) the interés de demora tributario (tax arrears), currently 4.0625% = legal interest × 1.25 under Ley 58/2003 art. 26.6, fixed in apartado Dos of the same disposición adicional; (2) the interés de mora procesal on money judgments, which is the legal interest + 2 percentage points under Ley de Enjuiciamiento Civil art. 576 — 5.25% at the current legal rate; (3) the insurer's penalty interest under Ley 50/1980 art. 20.4, which is the legal interest × 1.5 and floors at 20% once two years have passed. NEXT FIXING: only when a new Ley de Presupuestos Generales del Estado is approved and published in the BOE with its own disposición adicional on the interés legal del dinero — there is no scheduled date while the budget remains prorogued, so the rate can stand unchanged across whole calendar years.
