What this value means
Lithuania fixes its civil statutory interest in the Civil Code itself, with no reference rate and no setter: 5% per annum under art. 6.210(1) for money obligations generally. TWO-TIER, AND THE SECOND TIER IS NOT THE DIRECTIVE RATE: art. 6.210(2) raises the figure to 6% per annum where BOTH parties to the contract are entrepreneurs (verslininkai) or private legal persons. That 6% is still a Civil Code rate, applying to business dealings that fall outside the commercial late-payment regime — it is not, and must not be substituted for, the Late Payment Directive rate. Both tiers yield to any different rate set by statute or agreed in the contract ('jeigu įstatymai ar sutartis nenustato kitokio palūkanų dydžio'). DO NOT USE FOR COMMERCIAL TRANSACTIONS COVERED BY THE SPECIAL LAW: payments under commercial contracts fall under the Mokėjimų, atliekamų pagal komercinius sandorius, vėlavimo prevencijos įstatymas, where the rate is the ECB main refinancing rate plus 8 percentage points, snapshotted at 1 January for the first half-year and 1 July for the second — a figure several times this one, served separately as this API's late-payment-interest product. PROCEDURAL INTEREST: under CK 6.37(2) a debtor also owes statutory interest on the sum awarded from the day proceedings are commenced until the judgment is fully satisfied; where no other rate applies, that is calculated at the art. 6.210 rate, so litigation does not by itself change the percentage. Interest under art. 6.210 is compensatory and simple; Lithuanian case law (Supreme Court) does not allow compensatory interest and contractual penalty interest (delspinigiai) for the same period to be stacked. NEXT FIXING: none — art. 6.210 has stood unamended since the Civil Code entered into force on 1 July 2001 and changes only by amendment of the Code.
