What this value means

This is the NON-COMMERCIAL statutory rate — the damages owed for delay in paying a money debt under art. 6:119 BW where the debt does not arise from a handelsovereenkomst: consumer and private debts, unjust enrichment, tort damages, and the interest a court adds to a judgment sum. It stands at 4% from 1 January 2026, reduced from 6%, which had applied through 31 December 2025. Setter: the Crown by algemene maatregel van bestuur under art. 6:120(1) BW, on the proposal of the Minister of Justice. THIS IS A DECISION, NOT A FORMULA: the guideline is the ECB refinancing rate plus about 2.25 points, but the rate only changes when a besluit is made and published in the Staatsblad, so it does NOT track the ECB and can sit unchanged for years. Changes have taken effect on 1 January and on 1 July. COMPOUNDING TRAP: art. 6:119(2) BW capitalises the interest — at the end of each full year the accrued interest is added to the sum on which interest is computed, so a multi-year claim is not simple interest. Commercial invoices are a different product: art. 6:119a BW (wettelijke handelsrente) applies to handelsovereenkomsten between businesses or with a public authority, is set by art. 6:120(2) BW at the ECB refinancing rate plus 8 points and reset each half-year, and stands at 10.4% since 1 July 2026 — that regime is served in our late-payment-interest product. NEXT FIXING: no scheduled date; a change requires a new algemene maatregel van bestuur, in practice published in the Staatsblad in December for 1 January or in June for 1 July.
