What this value means
EU-harmonised statutory interest for late payment in commercial transactions = ECB main refinancing rate (snapshotted on 1 January / 1 July) + 8 percentage points (Directive 2011/7/EU, art. 2). This is the Directive MINIMUM and the figure the European Commission publishes per member state; national transposition may set a HIGHER rate for some transaction types. Because it is a half-yearly snapshot, the value tracks the MRO as of the half-year start, not today's live MRO. Derived live from this country's ecb-main-refinancing-rate series. Implemented in Slovenia through the Prevention of Late Payment Act (ZPreZP-1) together with the Obligations Code, with the rate itself set by ZPOMZO-1 as the ECB main refinancing rate plus 8 percentage points, fixed for each six-month period beginning 1 January and 1 July (a basis introduced by ZPOMZO-1A from 2007-01-01). That gives 10.40% for H2 2026 on the 2.40% reference rate, published in Uradni list RS and also carried by Banka Slovenije. Slovenia maps cleanly onto the euro-area default. THE RATE IS FROZEN FOR EACH HALF-YEAR, which changes how accruals must be computed. Slovenia's statutory default interest is set by the Zakon o predpisani obrestni meri zamudnih obresti (ZPOMZO-1-UPB1, Uradni list RS 11/07) at the ECB main refinancing rate plus 8 percentage points, and Article 2(2) provides that the rate 'velja za sestmesecno obdobje, ki se zacne s 1. januarjem oziroma 1. julijem' - it does not move mid-period even if the ECB does. The ECB's 17 June 2026 increase to 2.40% therefore did NOT change the first-half rate of 10.15%; it fed only into the second-half notice of 10.40%, published in Uradni list RS 1124/26 on 3 July 2026 (adopted 1 July; note that several accounting portals give 7 July, which is wrong). Any interest calculation spanning a 1 January or 1 July boundary must be SPLIT at that boundary and each segment charged at the then-fixed rate. The Late Payment Directive 2011/7/EU is transposed by the Zakon o preprecevanju zamud pri placilih (ZPreZP-1, Uradni list RS 57/2012, in force 28 July 2012), which is the only measure Slovenia notified, though Article 2 states the transposition is partial (delno) with the remainder in the Obligacijski zakonik and ZPOMZO-1. PAYMENT TERMS ARE NOT '30 DAYS BY DEFAULT, 60 BY AGREEMENT', a common misstatement: the business-to-business CAP is 60 days by ordinary agreement (Article 10(1)), longer than 60 days requires writing and must not be grossly unfair (Article 10(2)), 30 days is the gap-filler when nothing was agreed (Article 12) and separately the cap where the debtor is a public authority (Article 11(1)), and fixed recovery compensation is 40 EUR per claim (Article 14). Since Slovenia is in the euro area and applies the bare 8-point minimum with no national top-up, the Commission's published commercial late-payment rate and the ZPOMZO-1 rate are identical and structurally always will be.
