What this value means

CIVIL AND COMMERCIAL ARE UNIFIED IN SLOVENIA — there is one prescribed default rate and it is this one. ZPOMZO-1 art. 1(1) applies it to 'denarne obveznosti od dneva nastanka dolžnikove zamude do dneva plačila' (money obligations, from the day the debtor's default arises until payment), without distinguishing civil from commercial; Obligacijski zakonik art. 378 makes it the rate a defaulting money debtor owes on top of the principal; and ZPreZP-1, which transposes the Late Payment Directive for commercial transactions, refers back to the same ZPOMZO-1 rate. Slovenia's late-payment-interest product and this record therefore carry the same figure and move together — that is correct, not a duplicate. HALF-YEARLY SNAPSHOT, NOT CONTINUOUS TRACKING: ZPOMZO-1 art. 2(1) sets the rate as the ECB leading rate + 8 percentage points, and art. 2(2) fixes it 'za šestmesečno obdobje, ki se začne s 1. januarjem oziroma 1. julijem' — for the six-month period beginning 1 January or 1 July. The leading rate is the ECB main refinancing rate applied in the operation carried out BEFORE the first day of that half-year, so an ECB move mid-half-year does not change the rate until the next 1 January or 1 July. The rate held at 10.15% for the whole of H1 2026 and stepped to 10.40% only on 1 July 2026, after the ECB's June increase. Because Slovenia snapshots and neighbouring countries track continuously, cross-border comparisons drift for months at a time. THE PARTIES CAN OPT OUT: ZPOMZO-1 art. 1(2) — 'Predpisana obrestna mera zamudnih obresti se ne uporablja, če se tako dogovorita upnik in dolžnik' — the prescribed rate does not apply where creditor and debtor agree otherwise, subject to the limits ZPreZP-1 imposes on grossly unfair terms in commercial contracts. NO ULTRA ALTERUM TANTUM CAP ON DEFAULT INTEREST: the old Obligacijski zakonik art. 376, which stopped interest once accrued unpaid interest equalled the principal, was deleted by OZ-A in 2007; the replacement, art. 382a, preserves the cap for CONTRACTUAL interest only. Statutory default interest now runs without that ceiling, except on obligations that predate the amendment, where case law following Constitutional Court decision U-I-300/04 still applies the old rule. Interest is simple, not compounded. NEXT FIXING: for the six-month period beginning 1 January 2027, published by the Minister of Finance in the Uradni list in the first days of January; Banka Slovenije also maintains the series at bsi.si under 'Temeljna in zamudna obrestna mera'.
