What this value means
This is the CIVIL-LAW rate — Občiansky zákonník § 517(2) gives a creditor of an unpaid money debt the right to default interest, and government decree 87/1995 Z. z. § 3 fixes it at the ECB base rate plus 5 percentage points. THE RATE IS FROZEN PER DEBT, NOT PER PERIOD: the decree takes the ECB base rate 'platná k prvému dňu omeškania' — in force on the FIRST DAY OF THE DELAY — and that rate then applies for the entire duration of the delay. Later ECB moves do not change an existing claim, and two debts that fell due weeks apart can carry permanently different rates. 7.40% is the figure for delays that began on or after 17 June 2026 (ECB base rate 2.40%); a delay that began between 11 June 2025 and 16 June 2026 runs at 7.15% for its whole life, and one beginning between 16 March 2016 and 26 July 2022 still runs at 5.00%. The Ministry of Justice deliberately publishes no table for the civil rate — it tells users to read the ECB base rate for the relevant first day of delay. DO NOT USE FOR B2B COMMERCIAL DEBTS: commercial relations run under Obchodný zákonník § 369 and government decree 21/2013 Z. z., where the rate is the ECB base rate PLUS 8 percentage points, reset for each calendar half-year (10.40% from 1 July 2026) — served separately as this API's late-payment-interest product. That regime also offers the creditor an election under § 1 ods. 2 of decree 21/2013: instead of the half-yearly rate, a FIXED rate of the ECB base rate on the first day of delay plus 9 percentage points, locked for the whole delay. No such election exists on the civil side. CONSUMER CAP: under § 3a of decree 87/1995, where a consumer contract provides money to a consumer, the total sanctions for the consumer's delay may not exceed the last published average annual percentage rate of charge for a comparable consumer credit by more than 10 percentage points per year, and may not exceed three times the default interest under this decree. NEXT FIXING: there is no fixing date — the figure for newly arising defaults changes on the day a new ECB main refinancing (base) rate takes effect, so it must be re-read after each ECB Governing Council monetary policy decision. NBS republishes the ECB base rate for Slovak purposes.
