What this value means

What a payroll engine gets wrong in Poland, in order of how much money it costs: 1. ONE CEILING, THREE BRANCHES, AND IT IS ANNUAL. The 282 600 zł limit for 2026 (30 × the forecast average wage of 9 420 zł, M.P. z 2025 r. poz. 1206) is a single shared, cumulative, year-to-date limit that applies ONLY to emerytalne, rentowe and FEP. It does NOT apply to chorobowe (art. 20 ust. 2), wypadkowe (art. 20 ust. 2), zdrowotne (art. 81 ust. 5 of the health act), Fundusz Pracy (art. 259 ust. 1), Fundusz Solidarnościowy or FGŚP (art. 29 ust. 1) — each of those instruments disapplies art. 19 ust. 1 in terms. It is not a monthly cap and not a per-branch cap: contributions run at full rate until the year-to-date base reaches 282 600 zł, then stop entirely for the remainder of the calendar year. 2. THE CEILING FOLLOWS THE EMPLOYEE, NOT THE EMPLOYER. Art. 19 ust. 6 aggregates across all payers; the employee must notify each of them on crossing, and the employee — not the employer — carries liability for a wrong notification. A single-employer engine will over-collect for multi-employer employees and has no way to detect it. 3. CEILING VERSUS THRESHOLD. Poland has both and they behave oppositely. The 282 600 zł figure is a true ceiling (contributions stop above it). The 4 806 zł monthly minimum wage in art. 259 ust. 1 ustawy o rynku pracy i służbach zatrudnienia is a LIABILITY THRESHOLD for Fundusz Pracy and Fundusz Solidarnościowy: below it nothing is due; at or above it the levy is due on the whole base, not on the excess. FGŚP has no such threshold at all and is due from the first złoty. Treating the minimum wage as a floor to be netted off is a classic error. 4. RENTOWE IS NOT SPLIT EVENLY. Art. 16 ust. 1b fixes 1,5 % employee / 6,5 % employer. Only emerytalne is split in equal parts (art. 16 ust. 1). Assuming symmetry costs 5 percentage points of employer cost. 5. THE HEALTH BASE IS NOT GROSS. Art. 81 ust. 6 reduces the base by the employee-financed social contributions actually withheld (9,76 + 1,50 + 2,45 = 13,71 %). Effective burden is 9 % × 86,29 % ≈ 7,766 % of gross. Art. 83 ust. 1 and 2b then cap the monthly contribution at the PIT advance that WOULD have been due under the rules in force on 31 December 2021 — this bites for low earners; art. 83 ust. 2 and 2a drive it to zero or to that notional figure for PIT-exempt income, notably the under-26 exemption. 6. DEDUCTIBILITY. Employee social contributions (emerytalne, rentowe, chorobowe) withheld by the payer ARE deductible from the PIT base — art. 26 ust. 1 pkt 2 lit. b ustawy o PIT. The health contribution is NOT deductible in any form: art. 27b PIT was repealed by the 'Polski Ład' act (Dz. U. z 2021 r. poz. 2105) with effect from 1 January 2022. Code still deducting 7,75 % of the health base from tax due is carrying a four-year-old bug. 7. CONSOLIDATED-TEXT TRAPS. (a) Art. 22 ust. 1 pkt 4 of the consolidated ustawa o systemie ubezpieczeń społecznych states the accident-insurance rate as 'od 0,40 % do 8,12 %'. That is the theoretical span of zał. nr 1 to the rozporządzenie (risk categories 1–30). No activity group is actually assigned outside 0,67 %–3,33 % in the operative zał. nr 2. Both are reported here; the regulation is operative. (b) The accident regulation's own consolidated text has moved: Dz. U. z 2022 r. poz. 740 is superseded by Dz. U. z 2025 r. poz. 1874 (obwieszczenie z 12 grudnia 2025 r.), which folds in the 2024 risk-category revision — several groups changed materially (e.g. A-01 agriculture from 2,53 % to 1,47 %; B-05 coal mining from 3,06 % to 3,33 %). Serving the 2022 table gives wrong per-employer rates. (c) The Fundusz Pracy basis moved statute entirely: the ustawa z 20 kwietnia 2004 r. o promocji zatrudnienia i instytucjach rynku pracy was repealed by the ustawa z dnia 20 marca 2025 r. o rynku pracy i służbach zatrudnienia (Dz. U. z 2025 r. poz. 620) from 1 June 2025; art. 104 of the old act no longer exists. (d) ZUS's own rates page still cites the ustawa o systemie ubezpieczeń społecznych as 'Dz. U. 2021 r. poz. 423'; the current consolidated text is Dz. U. z 2026 r. poz. 199. 8. THREE RATES LIVE IN THE ANNUAL BUDGET ACT, NOT IN THEIR OWN STATUTES. Fundusz Pracy (art. 260 ustawy o rynku pracy), Fundusz Solidarnościowy (art. 4 ust. 2) and FGŚP (art. 29 ust. 2) all delegate their rates to the ustawa budżetowa. For 2026 these are art. 25 (1,0 %), art. 26 (1,45 %) and art. 27 (0,10 %) of the Ustawa budżetowa na rok 2026 z dnia 9 stycznia 2026 r. (Dz. U. z 2026 r. poz. 62). They must be re-read from a new budget act every January. Fundusz Pracy and Fundusz Solidarnościowy are declared to ZUS as a single combined 2,45 % line (art. 5 ust. 2 ustawy o Funduszu Solidarnościowym) but are two legally distinct levies. 9. THE ACCIDENT RATE YEAR IS NOT THE CALENDAR YEAR. 'Rok składkowy' runs 1 April to 31 March (art. 27 ust. 1 ustawy wypadkowej). ZUS notifies payers with 10 or more insured of their rate by 20 April (art. 32). An engine that refreshes rates every 1 January will apply a stale accident rate for three months. 10. AGE- AND CATEGORY-DEPENDENT LIABILITY. Fundusz Pracy, Fundusz Solidarnościowy and FGŚP are all switched off for women aged 55+ and men aged 60+ (art. 261 ustawy o rynku pracy; art. 9b ust. 2 ustawy o ochronie roszczeń pracowniczych), plus 12-month exemptions for qualifying 50+ and under-30 hires and a 36-month exemption on return from maternity/parental/childcare leave. FEP applies only to employees born after 31 December 1948 performing work in special conditions. The figures above are for an employee on umowa o pracę; umowa zlecenia has voluntary rather than compulsory chorobowe and a student exemption under 26, and umowa o dzieło is generally outside ZUS entirely. 11. NATIONALITY. Liability does NOT depend on nationality or citizenship. It attaches to the insurance title — employment or mandate performed in Poland — so foreign nationals employed in Poland are covered on identical terms. What can displace Polish liability is EU coordination (Regulation (EC) No 883/2004, evidenced by an A1 certificate) or a bilateral social-security agreement, both of which turn on posting and applicable-law rules, not on passport. 12. EMPLOYER-BORNE IN FULL WHERE EMPLOYMENT WAS ILLEGAL. Art. 16 ust. 1e ustawy o systemie ubezpieczeń społecznych: on a finding of illegal employment or an understated contribution base, the emerytalne, rentowe and chorobowe contributions on the concealed pay do not burden the employee at all and are financed entirely by the payer. Remediation runs cannot simply back-withhold from the employee. Total employer-side cost for an ordinary private-sector employee below the ceiling, small employer (up to 9 insured), no exemptions: 9,76 + 6,50 + 1,67 + 1,00 + 1,45 + 0,10 = 20,48 % of gross, plus 1,5 % PPK where enrolled. Employee-side: 9,76 + 1,50 + 2,45 = 13,71 % of gross in social contributions, plus 9 % of the reduced base (≈ 7,77 % of gross) in health, plus 2 % PPK where enrolled. SUB-NATIONAL VARIATION: none — all rates, ceilings and thresholds are national. Poland has no regional or voivodeship variation in social-insurance rates. The only payer-level variation is the accident-insurance rate, which varies by PKD activity group and by employer risk experience, not by geography. WHAT WE DO NOT PUT A NUMBER ON: 1. No single national rate for ubezpieczenie wypadkowe — rate_employer and rate_total returned null deliberately. It is employer-risk-rated: 1,67 % flat for payers reporting up to 9 insured or not in REGON (art. 28 ust. 1 ustawy wypadkowej); for payers with 10 or more insured it is the PKD activity-group rate from zał. nr 2 (currently 0,67 %–3,33 % across 64 groups) multiplied by a ZUS-assigned correction index of 0,5 to 1,5 (art. 28 ust. 2, art. 31 ust. 1 pkt 2), which cannot be derived without the individual employer's PKD code, headcount and three years of accident data. I have given the exact bounds and the selection rule rather than a fabricated average. 2. No 2027 values stated. The 2027 annual ceiling does not yet legally exist — it requires a fresh obwieszczenie under art. 19 ust. 10, due by end of 2026. Press figures circulating for a 2027 average wage of 9 971 zł and a 2027 minimum wage of 4 950 zł are budget-assumption projections, not enacted instruments, and are not carried here. 3. No effective wypadkowe percentage quoted for any specific sector, and no attempt to reproduce the full 64-row zał. nr 2 table as verified values — I read its bounds and a sample of rows, not every row. 4. tax_deductible returned null for all employer-only branches (wypadkowe, Fundusz Pracy, Fundusz Solidarnościowy, FGŚP, FEP). The question as framed — deductibility of the EMPLOYEE contribution before income tax — has no employee contribution to attach to. These are employer business costs under corporate/business tax rules, which is a different question. 5. PPK is reported but flagged as quasi-mandatory rather than asserted as a mandatory statutory deduction: the employer's obligation to operate and fund it is unconditional, the employee's 2 % is an opt-out default. Anyone modelling it as a hard statutory withholding will over-deduct for opted-out employees. ALREADY LEGISLATED, NOT YET IN FORCE: 1. PKD 2025 replaces PKD 2007 for accident-insurance activity groups from 31 December 2026. The footnote to zał. nr 2, as amended by Rozporządzenie Ministra Rodziny, Pracy i Polityki Społecznej z dnia 18 września 2025 r. (Dz. U. z 2025 r. poz. 1292), reads: 'Do dnia 30 grudnia 2026 r. do grup działalności stosuje się Polską Klasyfikację Działalności (PKD) wprowadzoną rozporządzeniem Rady Ministrów z dnia 24 grudnia 2007 r.' From 31 December 2026 the mapping from employer to activity group changes classification basis. RE-VERIFY BY 2026-12-01 — this is the one hard-dated change in the set. 2. Annual ceiling for 2027: not yet fixed. Art. 19 ust. 10 requires the minister to publish it in Monitor Polski by the end of the preceding calendar year, so the 2027 obwieszczenie is due by 31 December 2026. RE-VERIFY FROM 2026-11-15. 3. INFERRED, NOT READ AS A STATED FIGURE: - The 9,76 % / 9,76 % emerytalne split. The statute states only 19,52 % (art. 22 ust. 1 pkt 1) and 'w równych częściach' (art. 16 ust. 1). The two 9,76 % figures are arithmetic. Corroborated by ZUS. - The ≈7,766 % effective health burden on gross, and the ≈0,335 %–4,995 % effective accident span for 10+-insured payers. Both are arithmetic from verified inputs, not quoted anywhere. - The 5 767,20 zł PPK reduction limit (1,2 × 4 806 zł) is computed from the verified minimum wage. - FGŚP applying to branches and representative offices of foreign entrepreneurs is my reading of art. 9; the article was read in full. COULD NOT READ: - zus.pl renders its rate tables client-side, so the ZUS page giving the employee/employer split table could not be retrieved as text. The split is taken from art. 16 of the statute, which is the stronger source. - I did not verify every one of the 64 rows of zał. nr 2 individually against the source of each employer's PKD mapping; I parsed the table and confirmed its bounds and a sample. - The ISAP web search interface is CAPTCHA-gated; all instrument retrieval was done through the Sejm ELI API and direct ISAP document URLs instead. Reported branches are those applying to an ordinary private-sector employee on an umowa o pracę. Not covered: KRUS (farmers), the separate schemes for uniformed services and professional soldiers, duchowni, and the special rules for zleceniobiorcy, self-employed and nianie. Researched against primary instruments and independently challenged by a second verification pass before being served (2026-08-08). Employee and employer shares are stated separately: the employee figure is what leaves the payslip, the employer figure is cost of employment and is not a deduction.
